1. Acceptance of Terms
By accessing and using LogiLite ("the Service"), you accept and agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use our Service.
These terms apply to all users of the Service, including logistics companies, delivery operators, administrators, and drivers who access the platform through web or mobile applications.
2. Use License
LogiLite grants you a limited, non-exclusive, non-transferable license to access and use the Service for your internal business operations related to logistics management, subject to these Terms of Use.
You may NOT:
- Modify, copy, or create derivative works of the Service
- Reverse engineer, decompile, or attempt to extract the source code
- Rent, lease, lend, sell, sublicense, or transfer the Service to third parties
- Use the Service for any illegal or unauthorized purpose
- Remove or alter any copyright, trademark, or proprietary notices
- Use automated systems to access the Service without our written permission
This license will automatically terminate if you violate any of these restrictions.
3. User Responsibilities
As a user of LogiLite, you are responsible for:
Account Security
Maintaining the confidentiality of your account credentials, including usernames and passwords. You are responsible for all activities that occur under your account. Notify us immediately of any unauthorized access or security breaches.
Data Accuracy
Ensuring that all information you provide (delivery orders, customer details, vehicle information, etc.) is accurate, current, and complete. Inaccurate data may affect service quality and reporting.
Compliance
Complying with all applicable laws and regulations, including but not limited to data protection laws (Malaysia Personal Data Protection Act 2010), transportation regulations, and export control laws.
Proper Use
Using the Service only for its intended purpose of logistics and delivery management. Do not use the Service to store, transmit, or process any illegal, offensive, or harmful content.
4. Service Availability
We strive to provide continuous access to LogiLite, but we do not guarantee uninterrupted or error-free service.
Service Level: We aim for 99.9% uptime, excluding scheduled maintenance. We will notify users in advance of planned maintenance when possible.
The Service may be temporarily unavailable due to:
- Scheduled maintenance and updates
- Emergency repairs or security patches
- Factors beyond our control (internet outages, cloud provider issues, natural disasters)
- Security incidents requiring immediate action
We recommend maintaining offline backup procedures for critical operations and data.
5. Payment Terms
If you subscribe to a paid plan:
- Fees are charged in advance on a monthly or annual basis, as selected during subscription
- All fees are non-refundable unless otherwise stated in your subscription agreement
- We reserve the right to modify pricing with 30 days' advance notice
- Failure to pay fees may result in service suspension or termination
- Taxes, if applicable, are your responsibility unless explicitly included in the quoted price
You may cancel your subscription at any time, though fees already paid are non-refundable. Service will continue until the end of your current billing period.
6. Intellectual Property
LogiLite and its original content, features, and functionality are owned by LogiLite and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.
Your Content:
You retain all rights to the data and content you upload to LogiLite (delivery orders, customer information, photos, signatures, etc.). By using the Service, you grant us a limited license to use, store, and process your content solely to provide and improve the Service.
We will not share, sell, or use your business data for any purpose other than providing the Service, except as required by law or with your explicit consent.
7. Limitation of Liability
To the maximum extent permitted by Malaysian law:
Disclaimer: The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
LogiLite shall not be liable for:
- Any indirect, incidental, special, consequential, or punitive damages
- Loss of profits, revenue, data, or business opportunities
- Service interruptions or delays
- Errors or inaccuracies in content or data
- Actions of third-party service providers
- Unauthorized access to or alteration of your transmissions or data
Our total liability for any claims related to the Service is limited to the amount you paid us in the 12 months preceding the claim, or RM 1,000, whichever is greater.
8. Indemnification
You agree to indemnify and hold harmless LogiLite, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:
- Your use or misuse of the Service
- Your violation of these Terms of Use
- Your violation of any third-party rights, including intellectual property or privacy rights
- Any content or data you submit to the Service
9. Termination
We may terminate or suspend your access to the Service immediately, without prior notice, for any reason, including:
- Violation of these Terms of Use
- Non-payment of fees
- Fraudulent or illegal activities
- Prolonged inactivity
- Risk to the security or integrity of the Service
Upon termination, you may request an export of your data within 30 days. After this period, we reserve the right to delete your account and associated data permanently.
10. Modifications to Terms
We reserve the right to modify these Terms of Use at any time. Changes will be effective immediately upon posting to this page, with the "Last updated" date revised accordingly.
For significant changes, we will provide at least 30 days' notice via email or through an in-app notification. Your continued use of the Service after changes take effect constitutes acceptance of the modified terms.
If you do not agree to the modified terms, you must stop using the Service and cancel your subscription.
11. Governing Law
These Terms of Use shall be governed by and construed in accordance with the laws of Malaysia, without regard to its conflict of law provisions.
Any disputes arising from these terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of Malaysia.
